tx submit api returns 200 with invalid transactions

I re-submitted a tx a partner provided that they said was being accepted but not ending up in explorer and confirmed it gets a 200 back, but checking the logs I see:

Currently every response that returns valid JSON daa has a HTTP 200 response code. The JSON then contains a "status" file which is either "success" or "fail"

First time:

in the logs, this looks like:
